Gift cards must be redeemed through the Killerspin.com retail website toward the purchase of eligible products. Purchases are deducted from the Gift Card balance. Any unused balance will remain in recipient’s Gift card account after redemption of eligible products. If an order exceeds the amount of the Gift Card, the balance must be paid with a credit card or other available payment method.
Gift cards cannot be redeemed for purchases from third party sellers.
Gift Cards cannot be used to purchase other Gift Cards.
Gift Cards cannot be reloaded, resold, transferred for value, redeemed for cash or applied to any other account, except to the extent required by law. Unused Gift Card balances in a Killerspin account may not be transferred.
Gift Cards and their use on the Killerspin.com website are subject to Killerspin Order Policy, Shipping Policy and Privacy & Safety Policy. Killerspin may provide Gift Card purchasers with information about the redemption status of Gift Cards.
The risk of loss and title for Gift Cards pass to the purchaser upon electronic transmission to the purchaser or recipient or delivery to the carrier, or whichever is applicable. Killerspin.com will have the right to close customer accounts and request alternative forms of payment if a fraudulently obtained Gift Card is redeemed and/or used to make purchases on the Killerspin.com website.
Killerspin.com and its affiliates make no warranties, express or implied, with respect to Gift Cards, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In the event a Gift Card code is non-functional, your sole remedy, and our sole liability, shall be the replacement of such Gift Card. Certain State laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.
The parties shall resolve the dispute through binding arbitration with one arbitrator chosen mutually by the parties. The arbitrator shall be qualified in the area of consumer and ecommerce transactions. The arbitration shall be completed within 120 days after notice of dispute delivered to Killerspin LLC. The arbitration shall take place in Chicago, Illinois. The parties shall split the arbitrator’s fees equally. The parties shall follow the Federal Arbitration Act 9 U.S.C. sec. 1-16 (FAA) and the Commercial Rules of the American Arbitration Association. The decision and award of the arbitrator shall be final and binding and the award so rendered may be entered in any court having jurisdiction thereof. The arbitrator’s decision shall be in strict compliance with the law. The arbitrator will have no authority to award punitive or other non-compensatory damages to either party and shall use the Federal Rules of Evidence.The arbitrator shall base his or her decision on the facts presented by the parties, the terms of the Killerspin policies and the law in effect at the time of the transaction and shall render a written reasoned decision.
